It would appear that everyone in the music business has decided to defer to Axl Rose and not make any news today, so I’ve spent the last hour or so trying to figure out who I’m going to see during my own personal CMJ Day One. (See, last night I saw this awesome act called The Insides Of My Eyelids–they performed for 11 1/2 hours straight, and had all these whacked-out conceptual pieces about the protagonist, who looked a lot like me, wearing wide-brimmed ceramic hats while trying not to embarrass herself in front of people she wanted to impress. Fun times!) I’m working off the official schedule, although I’ll probably peruse some no-badge-required listings on the subway downtown. Congratulations, world! You somehow made it all the way to Oct. 1, 2008, which means one thing: It’s time for Rocktober to start. How will you celebrate? Some people are linking to YouTubes of Who songs. Others are hoping that you’ll have a hankering to hear the Divinyls and Foreigner within the same span of time. One guy who got the coveted domain name “rocktober.com” is even saying that we should bring back Metallica Monday, although I know of a few people who might disagree with that idea. Tim Whitwell, writing in Word, puts aside tiresome ethics-of-illegal-downloading arguments and simply considers the concrete financial future of rock stars in this new era, and what they might soon have in common with the upper-middle class.

It’s A Bad Week To Be A Former Admin Of A Torrent Site

It was almost a year ago when the cute-avatar-adorned BitTerrorist hub OiNK got shut down by British and Dutch law enforcement, and today, former OiNK admin Alan Ellis was charged with conspiracy to defraud, while at least two former users of the site were charged with copyright infringement by the British authorities. (I’m sure some still-weeping OiNK fan has already made a semi-tortured 9/11 reference, if precedent is any indication.)

That Santana Song With Rob Thomas: It Was Even More Popular Than You Thought

The geekier music fans among you might want to pick up the current issue of Billboard, which is devoted to the 50th anniversary of the Hot 100 and has put together a ton of commemorative listings. Among them, of course, is the All-Time Hot 100, which–through some tricky data-weighing–placed Chubby Checker’s “The Twist” at No. 1. Right behind it is the unofficial song of Mets ace Johan Santana, “Smooth” by the Rob Thomas-assisted Santana; that track was also the No. 1 rock song of the modern era, so now you can all relax in the knowledge that, yes, it really was haunting your every moment for a period of time at the end of last century. But wait, there’s more! The top 25 of the All-Time Hot 100–plus a few other tidbits from said chart–after the jump.

Are The Feds Going To Make An Example Of The Guns N’ Roses Leaker?

Kevin Cogill, the Antiquiet proprietor who was arrested earlier this week for leaking nine songs from Guns N’ Roses’ eternally delayed Chinese Democracy, is out on $10,000 bond, and there’s a bounty on his head from none other than ex-Guns N’ Roses guitarist Slash: “I hope he rots in jail,” the curly-haired guitarist told the Los Angeles Times. “It’s going to affect the sales of the record, and it’s not fair.” Whether or not Cogill does “rot” in jail (and pay fines, and possible civil damages) rests on the court’s interpretation of the the Family Entertainment and Copyright Act of 2005, which makes the pre-release dissemination of even one song a felony. The act hasn’t been used much; one notable occurrence of its enforcement came when two people who leaked Ryan Adams’ Jacksonville City Nights before its street date were subsequently sentenced to two months of house arrest and two years probation. But lawyers that the Times spoke to hinted that Cogill’s punishment could be a bit harsher, thanks to the continued bottom-line hit that the biz has been taking.
